The Will of Martha Smith of TalbotCo, GA

In 1840 TalbotCo, Martha MITCHELL is found living next to William J F MITCHELL, son of Benjamin MITCHELL and mother unknown. William's stepmother, last wife of Benjamin, was Mildred Hatcher. Ben and Mildred are living nearby.

Martha has one male 15-20 in her household but, based on her will, she had no children of her own. She appears to be a wealthy widow, owning 34 slaves.

In Sept 1841, she married Charles W Smith and a year later, she wrote her will.

She bequeaths to the children of Wm J F Mitchell and to Martha W Hatcher, dau of John H [not B] Hatcher and his wife, Dorcas Ross.

The unknowns:

1) Is she a Hatcher, widow of an unknown Mitchell?
2) Is she related to Mildred Hatcher, Ben's wife?
3) Is she a Ross, married to a Mitchell?
4) Why did she bequeath to just Wm J F Mitchell but not to any of his sibs who were also living in TalbotCo?
5) Was the reason because she was related to the unknown mother of Wm, making only Wm a blood relation?

Will of Martha Smith

28 Sept 1842 Martha Smith of Talbot Co, do make & ordain this instrument as written and subscribed with my own hand in my one name to be my last will & testament revoking all others. All my debts of which there are but few, and none of magnitude, are to be punctually paid. My slaves Sam, Peter, Nathan, Jack, Daniel, Right, James, Tom, Bowman, Madison, Jefferson, Green, Sam Junior, Joe, William, George, Harriet, Clark, Caroline, Emeline, Susan, Mary, Sally, Jane, Patsy Ann, Martha, Also & Lucinda, be thrown into common stock which is to be kept together them & their increase and equally divided between William J F Mitchell and his 2 children, James J Mitchell & Martha Elizabeth Mitchell when said children come of age. All the land lying on Flint River in Talbot Co bounded east by Flint River, north & west by William J F Mitchell, south by A Gray & Joseph Riley and embracing the ferry on Flint River and one acre on the east side of said River at the landing, in all containing 700 acres. Also 2 squares of lots, no 1748 in the 14th Dist of originally Muscogee, now Talbot, to be kept for the use & benefit of said River Plantation as common stock, and said lands to be equally divided between James J Mitchell & Martha Mitchell when they become of age. Also bequeath to James J Mitchell exclusively one negro boy Brit about 12-14 yrs old. Likewise to Martha Elizabeth Mitchell, one negro girl Phoebe about 20 yrs old with future increase. I desire that certain lands be added to the common stock and equally divided between William J F Mitchell and his 2 children before mentioned, namely, lot #11, in the 15th Dist of orig. Muscogee Co, now Talbot, #36 in 7th Dist of originally Early, now Baker Co, #6 in the 6th Dist of Appling, and sundry lots in Cherokee and all other lands belonging to me not otherwise disposed of. I will that Lucinda, a negro girl which is named in the common stock be given up to Martha W Hatcher, daughter of John B Hatcher, or one equal in value to be purchased and paid for out of the estate. I appoint William J F Mitchell guardian for said James J & Martha E Mitchell in the management of their interest in my estate, and wish him to keep in his possession with the common stock the 2 negroes Brit and Phoebe until they come of age. 1752 October - Halifax Co [formed from Lunenburg in 1752]

At a Vestry held for Antrim Parish in Halifax County the xviijth Day of October 1752.
Ordered that the Church by the last Vestry Ordered to be built near the Buffalow Beds on Wynn's Creek be built according to the Dimentions in the said Order specified and it is further Ordered that there be Erected therein a Gallery and four Pews on each side, a good Pulpit, a Communion, and Table well Banistered round and good Doors and that the inside of the Church be well Cieled with Plank, Six Windows well Sashed with Eighteen Lights in each Window, ten inches by eight and Glass for the same and good foulding Shutters to each Window. The Roof is to be well Shingled with Pine, Red-Oak or Poplar Shingles and well Boarded on the outside with good Feather edged plank and to be Twelve feet Pitch in the Clear and Michael Machie with Jeremiah Hatcher his Security undertakes to Perform the same according to the Dimension and Descriptions above mentioned.

1772 March - Halifax Co

John Caldwell, Plaintiff, vs. Robert Hatcher, Defendant, on an attachment against the Defendant's estate. The Constable having returned that he had levied the said attachment on a [Lien], this day came the Plaintiff by his attorney, and the Defendant not appearing to replevy (although called) the Plaintiff made oath to his demand for 5 L. Therefore it is considered by the Court that the Plaintiff recover against the Defendant for his debt aforesaid, and his costs. And it is ordered that the Sheriff make sale of the said attached effects by way of auction to the highest bidder and return an account of such sale to the clerks office.

"We the subscribers herey oblige ourselves to pay on demand, to the commander of the militia of Powhatan, the several sums of money set against our names respectively, to be by him equally distributed amongst such able bodied men as will engage to serve in one of the Virginia regiments on continental establishment, for one year, in order to prevent a draught of the militia for completing the sd requirements; provided that not more than 200 dollars, besides the public bounty, be paid to any one person so enlisting.

A tithable in Chesterfield County in 1762, Blackman Ward was head of a household of three whites and one black in Chesterfield County in 1783. Blackman was living in Dale Parish when he gave 266 acres of the land where he lived to Amos Hatcher, son of Obadiah Hatcher, of Halifax County 2 October 1786. This land was next to the property of Thomas Clayton, James Ferguson, Seth Ward, deceased, Christopher Branch, Branch Tanner, and Benjamin Chaulkley.
